Should buyers of counterfeit goods also face penalties?

A discussion of penalties for counterfeit purchases needs to distinguish people deceived into believing an item was genuine, those who knowingly bought a fake, and those buying for resale. Establishing what a buyer knew and the purpose of the transaction is itself an important issue. This question neither describes current penalties nor encourages counterfeit trade. It asks how to balance the effect of consumer penalties on demand with verification responsibilities for sellers and platforms, and protection for victims.
